General Conditions of Sale

1. Scope of application
The General Terms and Conditions apply to all orders placed on the website by a consumer acting for personal purposes. Any order implies full acceptance of the General Terms and Conditions in force on the day of the order.
2. Products
The jewelry offered is handmade, in unique pieces, in solid silver (925 or 950) and adorned with authentic Tahitian pearls. Variations may exist due to the artisanal nature. The product sheets mention the essential characteristics.
3. Price
Prices are listed in euros, including VAT, excluding shipping costs. For orders outside Portugal, customs fees or local taxes may apply and are payable by the customer. Honu Handmade Jewellery reserves the right to change prices at any time without prior notice.
4. Order and payment
Orders are placed directly on the website. Payment is due upon ordering, using the secure payment methods offered (credit card, PayPal, Multibanco, etc.). All orders are only finalized after payment confirmation.
5. Delivery
Deliveries are made from Portugal, Europe, and internationally via the carriers suggested at the time of ordering. Delivery costs are indicated before validation. The customer is responsible for the delivery information provided.

If your package appears damaged or has been opened, we invite you to:
Either refuse the package for non-compliance.
Either accept the package by submitting a reservation describing the problem(s) to the delivery person.
Important: You have the right to inspect your goods before accepting them, and the delivery person is obliged to accept your reservation. Without a reservation on your part, no recourse against the carrier will be possible.
6. Withdrawal and returns
In accordance with Portuguese law and European Directive 2011/83/EU, the customer has 14 days from the order date to exercise their right of withdrawal, except for personalized products and earrings. Return shipping costs via tracked parcel and insurance up to the market value of the goods are the sole responsibility of the customer. Items must be returned unworn, in their original condition and in their original packaging.
6.1 Right of withdrawal – Terms of return of the jewel
In the event of exercising the right of withdrawal within the legal period of 14 days following receipt of the goods, the customer will bear the direct costs of returning the goods, in accordance with article 13.º of Decreto-Lei n.º 24/2014, of 14 de fevereiro¹, unless the professional has expressly agreed to bear them.

The jewel must be:
- Perfectly protected and packaged in its original packaging to prevent any damage during transport
- Returned by tracked mail (e.g. registered mail or carrier with tracking number)
- Insured up to its purchase value including VAT, covering the risks of loss, theft or damage during transport.
The return is the sole responsibility of the customer.
In the event of loss, theft or damage to the returned item, without proof of tracked shipping or insurance covering the declared value, no refund can be required.
The refund
The refund of the jewel will be made after receipt and verification of its good condition, within a maximum period of 14 days from this receipt, according to the initial payment method.
Earrings, sets containing earrings, and personalized, engraved, or custom-made items are not eligible for return unless there is a proven manufacturing defect.
6.2 Exceptions to the right of withdrawal
In accordance with Article 17 of Legislative Decree No. 24/2014, of 14 February, certain orders are excluded from the right of withdrawal. These include:
- Custom Orders
The right of withdrawal does not apply to jewelry made to customer specifications or personalized (engraving, special size, choice of pearl or metal, custom design, etc.).
For reasons of hygiene and health protection, earrings cannot be returned if they were delivered in sealed packaging and the packaging was opened or unsealed after delivery.
- Sets containing earrings
When the earrings are an integral part of a set of jewelry (paraure) sold indivisible, the withdrawal will not be accepted if the sealed packaging containing the earrings has been opened, due to the applicable hygiene standards.

7. Legal guarantees
In accordance with Portuguese Decree-Law No. 84/2021, the Portuguese Civil Code and European Directive (EU) 2019/771, all jewelry sold by Honu Handmade Jewellery benefits from the legal guarantee of conformity and, where applicable, the guarantee against hidden defects.
7.1 Legal guarantee of conformity
The legal guarantee of conformity applies to defects in conformity existing at the time of delivery of the product. The customer has a period of 2 years from the date of delivery to assert this guarantee.
A lack of conformity may manifest itself for example by:
- a defective weld,
- a piece of jewelry that does not match the description provided,
- a structural malfunction of the product.
- a pearl presented as natural but which is not.
A defect affecting the quality or expected use (e.g., unmentioned inclusion, hidden treatment of a stone). Abnormal wear or breakage due to a hidden defect.
The customer has 6 months from the discovery of the defect to report it in writing to Honu Handmade Jewellery customer service, accompanied by proof of purchase and photographs illustrating the problem observed.
When the defect is proven, the customer can choose between:
- free repair of the jewel,
- the replacement of the jewel with an equivalent,
- or, if these solutions are impossible or disproportionate, the reduction of the price or the cancellation of the contract with full reimbursement.
7.2 Warranty against hidden defects
In addition to the guarantee of conformity, Article 913 of the Portuguese Civil Code et seq. provides that the customer may exercise his right to the guarantee against hidden defects if the jewel has a defect not apparent at the time of purchase, which makes it unfit for the use for which it is intended or significantly reduces its value.
For example, if a serious and non-apparent defect makes the jewel, stone or pearl unfit for the intended use (internal crack, undisclosed treatment, counterfeiting, etc.).
In this case, the customer has 6 months from the discovery of the defect to inform Honu Handmade Jewellery, and this within 2 years from delivery.
7.3 Warranty Exclusions
Legal guarantees do not cover:
- Normal wear and tear related to use and time
- Damage caused by shocks, falls, twisting, intentional or accidental damage, chemical contact, lack of maintenance or inadequate maintenance, improper handling.
- Natural oxidation of the metal or alterations linked to the pH of the skin,
- Interventions, repairs or modifications carried out by unauthorized third parties.
Legal guarantees apply automatically, without costs or formalities for the customer.
7.4 Precious Metals Compliance and Certification
All jewelry offered on this site is made from precious metals legally authorized for sale in Portugal.
The products are tested and certified by Contrastaria Portuguesa, a department of INCM – Imprensa Nacional Casa da Moeda, the official body responsible for the control and certification of precious metal products. The purpose of this control is to verify whether the items comply with the legal alloy of the declared metal. After analysis, the quality is guaranteed by affixing an official hallmark (guarantee mark) directly to the piece. This procedure is carried out in accordance with Portuguese law on precious metals. 8. Intellectual Property
All creations, texts, photos, and content on the site are protected under intellectual property law. Any reproduction is prohibited without prior written authorization.
9. Applicable Law and Dispute Resolution
These General Terms and Conditions are subject to Portuguese law. In the event of a dispute not resolved amicably, the customer may resort to Livro de Reclamações Eletrónico ( www.livroreclamacoes.pt ) or to an entity for extrajudicial resolution of consumer disputes recognized by the Direção-Geral do Consumidor.

10. Partial disability
If any clause of these T&Cs should be declared invalid or inapplicable, this will not affect the validity of the other clauses, which will remain fully applicable.
11. No Waiver
The failure of Honu Handmade Jewellery to exercise any right or enforce any provision of these Terms and Conditions shall not be construed as a definitive waiver of such right or provision.
12. Legal framework and professional authorizations
The website www.honu-bijoux.com is operated by Isabelle Jacqueline BENATOUIL, operating under her own name, NIF/IVA 301290741, CAE 32122, CAE 47770, activity declared in Portugal since 01/11/2024.
Industrial Activity Title of Jewelry No. T10726 , issued in accordance with Portuguese legislation governing the professions of goldsmithing, jewelry and jewelry.
Title of Activity of Retail Trade of Jewelry at a Distance No. T10727 , authorizing the sale of jewelry via means of distance communication (in particular online), in accordance with current Portuguese regulations.
These General Conditions of Sale ("GCS") define the rights and obligations of the parties in the context of the online sale of creations offered by Honu Handmade Jewellery.
