Legal guarantees

In accordance with Portuguese Decree-Law No. 84/2021 , the Portuguese Civil Code and European Directive (EU) 2019/771 , all jewellery sold by Honu Handmade Jewellery benefits from the legal guarantee of conformity and, where applicable, the guarantee against hidden defects .

1. Legal guarantee of conformity

The legal guarantee of conformity applies to defects existing at the time of delivery of the product. The customer has two years from the date of delivery to invoke this guarantee.

A lack of conformity can manifest itself, for example, through:

• a faulty weld,
• a piece of jewellery that did not match the description provided.
• a structural malfunction of the product,
• a pearl presented as natural but which is not,
• a defect affecting the quality or intended use (e.g., undisclosed inclusion, concealed treatment of a stone),
• abnormal wear or breakage due to a hidden defect.

The customer has 6 months from the discovery of the defect to report it in writing to Honu Handmade Jewellery's customer service, accompanied by proof of purchase and photographs illustrating the problem observed.

When a defect is confirmed, the customer can choose between:

• free jewellery repair
• replacing the jewellery with an equivalent,
• or, if these solutions are impossible or disproportionate, a price reduction or cancellation of the contract with a full refund.

2. Guarantees against hidden defects

In addition to the guarantee of conformity, Article 913º of the Portuguese Civil Code and following articles provides that the customer may exercise their right to the guarantee against hidden defects if the jewellery has a defect not apparent at the time of purchase, which renders it unfit for its intended use or significantly diminishes its value.

For example, if a serious and non-apparent defect renders the jewellery, stone or pearl unfit for its intended use (internal crack, undisclosed treatment, counterfeiting, etc.).

In this case, the customer has 6 months from the discovery of the defect to inform Honu Handmade Jewellery, and this within 2 years from the delivery date .

3. Guarantee Exclusions

Legal guarantees do not cover:

• Normal wear and tear due to use and time,
• Damage caused by impacts, falls, twisting, intentional or accidental damage, chemical contact, lack of maintenance or inadequate maintenance, improper handling,
• Natural oxidation of the metal or alterations related to the skin's pH,
• Interventions, repairs or modifications carried out by unauthorized third parties.

The legal guarantees apply automatically, without cost or formalities for the customer.
