1. Scope

These Terms and Conditions of Sale (“GTC”) govern all orders placed on honu-bijoux.com by a consumer acting for personal purposes. Any order implies full and unconditional acceptance of the GTC in force on the date of the order. The contract is concluded in French. The website is operated by Isabelle Jacqueline Bénatouil, trading as a sole trader under the trade name Honu Handmade Jewellery (Tax Identification Number 301290741, Portugal).

2. Products

The jewellery on offer is handmade, each piece is unique, crafted from solid silver (925 or 950) and, where applicable, adorned with Tahitian Pearls. Variations may occur due to the Handcrafted nature of each piece. The product descriptions set out the key features.

3. Prices

Prices are quoted in euros, inclusive of all taxes, excluding delivery charges. The applicable delivery charges are shown before the order is confirmed. For orders outside Portugal, customs duties or local taxes may apply, payable by the customer. Honu Handmade Jewellery reserves the right to change its prices at any time; the applicable prices are those in force on the day the order is placed.

4. Ordering and payment

Payment is due at the time of ordering via the secure payment methods offered: credit card, PayPal, Multibanco, as well as payment in three instalments at no extra cost via Klarna (subject to eligibility). Orders are only finalised once payment has been confirmed. Payment in three instalments is provided by Klarna Bank AB (publ), an independent service provider; eligibility criteria and pre-contractual information are provided by Klarna upon completion of the order.

5. Delivery

Items are dispatched from Portugal via tracked and insured delivery. Delivery areas, times and charges are detailed in our Delivery Policy. The customer is responsible for ensuring the accuracy of the delivery address provided.

6. Cancellation and returns

In accordance with Decree-Law No. 24/2014 (Directive 2011/83/EU), the customer has 14 days from receipt of the goods to exercise their right of withdrawal, subject to the legal exceptions set out in Article 17 of Decree-Law No. 24/2014. The terms and conditions and the full list of exceptions are set out in our Refund Policy.

7. Statutory guarantees

In accordance with Decree-Law No. 84/2021, the Portuguese Civil Code and Directive (EU) 2019/771, all jewellery is covered by the statutory guarantee of conformity and, where applicable, the guarantee against hidden defects.

Guarantee of conformity: 3 years from the date of delivery. During the first two years, any defect is presumed to have existed at the time of delivery; in the third year, the burden of proof lies with the customer. A lack of conformity may be, for example, faulty brazing, jewellery that does not match its description, or a structural fault. The customer may choose repair, replacement, or, failing that, a price reduction or termination of the contract.

Hidden defects: pursuant to Article 913 et seq. of the Portuguese Civil Code, the customer may take action in the event of a non-apparent defect rendering the jewellery unfit for its intended use, within 6 months of discovering the defect and within 3 years of delivery.

Exclusions: normal wear and tear, impacts, drops, twisting, chemical contact, natural oxidation or deterioration caused by the skin’s pH, lack of maintenance, third-party alterations, and sizing errors. Guarantees apply automatically, without charge or formalities, including for personalised or bespoke items (the guarantee of conformity is a matter of public policy).

The jewellery is tested and certified by the Contrastaria Portuguesa (a department of the INCM), which applies an official hallmark that guarantees the legal alloy of the declared metal.

8. Gift vouchers

Gift cards are digital, issued as a unique code sent by email after payment, and can only be used on honu-bijoux.com. Available amounts: 100, 250, 500, 1,000 and 2,000 euros (including VAT). Validity: 1 year from activation. The gift card can be used in multiple transactions until the balance is exhausted; it is neither rechargeable nor exchangeable for cash. In accordance with Article 16(m) of Directive 2011/83/EU and Article 17 of Decree-Law No. 24/2014, the purchase of a gift card (digital content for immediate delivery) does not give rise to a right of withdrawal, to which the purchaser expressly consents at the time of purchase. In the event of a return of a product paid for with a gift card, the corresponding amount will be credited in the form of a new code; no cash refund will be given.

9. Additional charitable donation (Te mana o te moana)

Honu Handmade Jewellery donates, from its own profit margin and at no extra cost to the customer, 1 per cent of the pre-tax sale price of each piece of jewellery (5 per cent for the Kalunga Capsule) to the charity Te mana o te moana, which is dedicated to the protection of sea turtles in French Polynesia.

When placing an order, the customer may make a voluntary, optional donation, separate from the price of the piece of jewellery and of any amount. Honu Handmade Jewellery acts solely as an intermediary collector and passes on the full amount of donations, without any deduction. Once confirmed, the donation is final and cannot be withdrawn (as it is a separate transaction from the sales contract); it remains payable even if the jewellery is returned, unless the order is cancelled in full before dispatch.

9.1. Tax receipt

Honu Handmade Jewellery does not issue any tax receipts in respect of additional donations.

The issue of tax receipts falls solely within the competence and responsibility of TE MANA O TE MOANA, within the limits of the legislation applicable to its status as an association under French law.

By choosing to make an additional donation, the donor explicitly consents, in accordance with the GDPR, to the automatic transfer of their personal data (the same data they provided when confirming their basket) to Te mana o te moana for the purpose of issuing and sending the tax receipt. 

10. Intellectual property

All content on the website (text, photographs, logos, jewellery designs, Collection names) is the exclusive property of Honu Handmade Jewellery. The Honu Handmade Jewellery trademark is registered with the EUIPO under number 019234592 (registered on 19 December 2025), conferring exclusive protection across the 27 Member States of the European Union. Any unauthorised reproduction, imitation or use may result in civil and criminal proceedings.

11. Governing law and dispute resolution

These Terms and Conditions are governed by Portuguese law, without prejudice to the mandatory consumer protection provisions of the customer’s country of residence. In the event of a dispute that cannot be resolved amicably, the customer may submit a complaint via the Livro de Reclamações Eletrónico (livroreclamacoes.pt) or to an out-of-court dispute resolution body recognised by the Direção-Geral do Consumidor:

12. Partial invalidity and non-waiver

If any provision of these Terms and Conditions is declared invalid, the remaining provisions shall remain in full force and effect. The fact that Honu Handmade Jewellery does not invoke a provision at a given time does not constitute a waiver of the right to invoke it at a later date.
