General Terms and Conditions of Sale

1. Scope

These General Terms and Conditions of Sale ("GTC") govern any order placed on honu-bijoux.com by a consumer acting for personal purposes. Placing an order constitutes full and unconditional acceptance of the GTC in force on the date of the order. The contract is concluded in French. The website is operated by Isabelle Jacqueline Bénatouil, trading as a sole proprietor under the trade name Honu Handmade Jewellery (NIF 301290741, Portugal).

2. Products

The jewellery offered is handmade, in unique pieces, in solid silver (925 or 950) and, where applicable, set with Tahitian pearls. Variations may occur owing to the handcrafted nature of each piece. Product pages detail the essential characteristics.

3. Prices

Prices are quoted in euros, inclusive of all applicable taxes, excluding delivery charges. Applicable delivery charges are displayed before order confirmation. For orders shipped outside Portugal, customs duties or local taxes may apply and are the responsibility of the customer. Honu Handmade Jewellery reserves the right to modify its prices at any time; the applicable prices are those in force on the date of the order.

4. Order and Payment

Payment is due at the time of ordering via the secure methods available: credit or debit card, PayPal, Multibanco, and three interest-free instalments via Klarna (subject to eligibility). An order is only confirmed once payment has been validated. Instalment payments are provided by Klarna Bank AB (publ), an independent service provider; eligibility criteria and pre-contractual information are supplied by Klarna at checkout.

5. Delivery

All pieces are dispatched from Portugal by tracked and insured delivery. Delivery zones, timeframes, and charges are detailed in our Shipping Policy. The customer is responsible for the accuracy of the delivery address provided.

6. Withdrawal and Returns

In accordance with Decreto-Lei n.º 24/2014 (Directive 2011/83/EU), the customer has 14 days from receipt of the goods to exercise their right of withdrawal, subject to the statutory exceptions set out in Article 17.º of Decreto-Lei n.º 24/2014. 7. Legal Guarantees

In accordance with Decreto-Lei n.º 84/2021, the Portuguese Civil Code, and Directive (EU) 2019/771, all jewellery benefits from the statutory guarantee of conformity and, where applicable, the guarantee against hidden defects.

Guarantee of conformity: 3 years from delivery. During the first two years, any defect is presumed to have existed at the time of delivery; during the third year, the burden of proof falls on the customer. A lack of conformity may include, for example, defective brazing, a piece that does not match its description, or a structural fault. The customer may choose repair, replacement, or, failing that, a price reduction or cancellation of the contract.

Hidden defects: pursuant to Article 913 et seq. of the Portuguese Civil Code, the customer may bring a claim in the event of a non-apparent defect rendering the jewellery item unfit for its intended use, within 6 months of the discovery of the defect and within 3 years of delivery.

Exclusions: normal wear, impact, dropping, twisting, chemical contact, natural oxidation or alteration due to skin pH, lack of care, third-party intervention, and incorrect sizing. The guarantees apply automatically, at no cost and without formality, including for personalised or bespoke pieces (the conformity guarantee is a matter of public policy).

The jewellery is tested and certified by the Contrastaria Portuguesa (a service of the INCM), which applies an official hallmark guaranteeing the legal alloy of the declared metal.

8. Gift Cards

Gift cards are digital, issued as a unique code sent by email upon payment, and redeemable exclusively on honu-bijoux.com. Available denominations: 100, 250, 500, 1,000 and 2,000 euros (VAT inclusive). Valid for 1 year from activation. The gift card may be used in multiple transactions until the balance is exhausted; it is neither rechargeable nor redeemable for cash. In accordance with Article 16(m) of Directive 2011/83/EU and Article 17 of Decreto-Lei n.º 24/2014, the purchase of a gift card (digital content with immediate execution) does not give rise to a right of withdrawal, the purchaser expressly consenting to this at the time of purchase. In the event of a return of a product paid for with a gift card, the corresponding amount is re-credited in the form of a new code, with no cash refund.

9. Additional Solidarity Donation (Renatura Congo)

Honu Handmade Jewellery donates, from its own margin and at no additional cost to the customer, 1% of the pre-tax selling price of each jewellery item (5% for the Capsule Kalunga) to the Renatura Congo association, dedicated to the protection of sea turtles.

At the time of ordering, the customer may add a voluntary donation, optional, separate from the price of the jewellery, and freely determined in amount. Honu Handmade Jewellery acts solely as a collecting intermediary and passes on the entirety of the donations, without deduction. Once confirmed, the donation is final and does not give rise to a right of withdrawal (it constitutes an act separate from the sales contract); it remains non-refundable in the event of a return of the jewellery, except in the event of full order cancellation prior to dispatch. No tax receipt is issued and the donation does not entitle the donor to any tax deduction. The donor's contact details are shared with Renatura Congo only with their explicit consent (via an opt-in box, unticked by default), in accordance with the GDPR. 10. Intellectual Property

All content on the site (texts, photographs, logos, jewellery designs, collection names) is the exclusive property of Honu Handmade Jewellery. The Honu Handmade Jewellery trademark is registered with the EUIPO under number 019234592 (registered on 19 December 2025), conferring exclusive protection across all 27 Member States of the European Union. Any unauthorised reproduction, imitation or exploitation is liable to civil and criminal proceedings.

11. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by Portuguese law, without prejudice to the mandatory consumer protection provisions of the customer's country of residence. In the event of a dispute that cannot be resolved amicably, the customer may contact the Livro de Reclamações Eletrónico (livroreclamacoes.pt) or an out-of-court dispute resolution entity recognised by the Direção-Geral do Consumidor:

12. Partial Invalidity and Non-Waiver

Should any clause of these Terms and Conditions be declared invalid, the remaining clauses shall retain their full effect. Honu Handmade Jewellery's failure to enforce any clause at any given time shall not constitute a waiver of its right to do so subsequently.
